Definition For Administrative Law
Administrative law is a part of public law and includes the administrative procedures, rules and regulations that government bodies must follow. It also lays down the scope and enforcement powers of government authorities. This law also provides for access to information pertaining to government agencies.
Administrative law contains the legal principles governing the administration and regulation of federal and state government agencies. It is considered a branch of public law and commonly called regulatory law. Decision making in the daily activities of various federal and state agencies is governed by administrative law.
The primary focus of administrative law is to regulate government bodies undertaking administrative decisions and activities, such as boards, tribunals and commissions. Further, the agencies authorized under administrative law are involved in decision making. They are responsible for making decisions in various areas, such as taxation, trade, commerce, broadcasting, environment and labor related issues.
Government authorities authorized under the administrative law enjoys several powers. These powers include issuing licenses and permits, initiating investigation and providing relief for complainants. Further, these agencies observe the activities of government and if necessary issue orders towards their adherence with specific rules.
The provisions of administrative law are less open to review in comparison to criminal and civil law. However, the provisions of administrative law lay down a procedure of review.
Several countries have specialized administrative courts. These special courts examine the decisions taken by government authorities. Administrative law judges employed in such courts are public officials, authorized to exercise quasi-judicial powers. They are empowered to conduct hearings, issue findings of fact and orders of compliance.
Administrative law in every country and every legal system has its specific features but object of legal regulation is the same. This branch of law is centered around government bodies and agencies, law regulating their activities and review of decisions made by government bodies.
